Bendicom collect your contact information (name, address, e-mail address, and phone numbers) and financial information (credit card details), to process your order. Bendicom will not use this information for any purpose other than to complete a customer order, or to communicate with the customer to discuss associated problems or delays concerning their order(s). We may share this information and only that information which is absolutely necessary, with those third parties that are involved in the processing of your order. For example, the financial institution that issued your credit card and the shipping carrier that delivers your order. Customers can access and update their details by logging into Bendicom web site. A forgotten password can not be retrieved in its original form. A new password must be re-issued each time the customers request a password. Customers can have the re-issued new password sent to them by submitting the correct E-mail address.
Credit Card Information
Your credit card details are used for the purpose of payment of a customer order by third party banking, (third party being Bendicom). Bendicom will at no time disclose this information for any purpose other than to use these details for the payment of a customer order. The customer gives us their authority to use these details for payment of their orders by using this web-site or by submitting them through facsimile. All credit card details are encrypted during on-line data transfer using Secure Sockets Layer (SSL) technology. Credit card details are not stored in Bendicom database/servers. Customers must submit the credit card details each time you place an order.
Bendicom is committed to reducing the amount of fraud it faces. Our policy is that we will prosecute any cases of fraud that we identify. As a first time customer, you may receive a telephone call or E-mail requesting more information or proof (e.g. faxing a copy of the credit card) to confirm the details that you have supplied to us. If any of the information you supply is found to be false or misleading, we will, if we deem it appropriate, report this to the appropriate authorities for them to prosecute.
E-mail Address
The E-mail address you submitted during an order will be used by Bendicom for the sole purpose of extended customer service. Bendicom will only use your E-mail address to communicate with you about the status, cost and shipping details, or any other changes required about your order. We may also send E-mails to customers for important events such as change of address etc. The E-mail address you submit to join the newsletter mailing list will be used by Bendicom for the sole purpose of sending regular newsletters. We maintain the newsletter E-mail list separate from the ones stored in the customer database. Newsletters will not be sent to those E-mail addresses stored in the customer database.
Limitation of Liability
All products sold on this website are to be used at your own risk. Under no circumstances is Bendicom liable for the following:
(1) third party claims against you for damages,
(2)loss of, or damage to your records, data, or any type of hardware/equipment,
(3) economic consequential damages (including lost profits, lost data, or lost savings), or incidental damages
(4) any consequential damages. Consequential damage is defined as any damage which is a consequence of using this product or our website (data loss; hardware loss; or economic losses like profit loss, customer loss, or time loss).
Bendicom's liability is limited to the cost of the product purchased from us. All of the products that we sell are to be used at your own risk and we are in no way liable for any loss, damage or injuries suffered from poor installation or use. Once shipped, goods become the responsibility of the customer which then has consumer rights to the goods being delivered by the carrier. All images displayed are for illustrative purposes only, and all specifications shown are true and accurate to the best of our knowledge. The material and information provided on this Website and related communications are provided on an "as is" basis. We, nor the provider of the data (if different), represents or guarantees, or accepts any liability whatsoever in respect of, the accuracy, currency or completeness of any of this data. Compatibility
We are unable to guarantee compatibility between components. It is up to the buyer to first research and confirm that a part will be compatible and suitable for their application prior to purchase. Shortages: Please inspect the contents of your shipment carefully upon your receipt of it. You have three (3) days after confirmed delivery to report any shortages in the shipment. We will not accept any responsibility, or offer any options after those three days have passed. Damage in transit: Please note that insurance is available for goods in transit and must be purchased at time of ordering. Please inspect the contents of your shipment carefully upon your receipt of it. You have three (3) days to report any items that have arrived damaged or broken in transit.
Warranty
All products carry a minimum manufacturer warranty of 12 months unless specified otherwise. If you have any difficulties with a product purchased, please apply for warranty online by following the link in Your Account. All warranty is strictly return-to-base, return postage will be payable for goods to be sent back once repaired or replaced. If any goods are faulty contact us on (03) 5448 5425 and ask for a return authority. We will then pass the goods onto our supplier who will repair / replace them. You are responsible for costs in getting the item to us, we will (within Australia and up to the amount of $10) return the goods to you when they are repaired / replaced.All custom built systems carry a 24 month warranty. Loss of data is not covered in these terms, misuse of the products are the liability of the customer this includes but is not limited to over-clocking and willful damage. Damage caused by power surges, spikes and disruption are not covered by this warranty.
Payment Methods
Bendicom accepts payment by Pay Pal, Direct Deposit, Money Order, Visa, MasterCard and Bankcard. All credit card orders are subject to verification and approval. If goods are sent without payment, ownership of the goods does not pass to you until we have cleared funds. Likewise if you make a payment and later it is withdrawn, the goods remain our property. If you owe us money for any reason and it is not paid within 30 days, interest at 2% above the current standard bank interest rate per month (calculated daily) will apply.
Pricing Policy
Prices are set at the time of purchase and are subject to change without notice. We reserve the right to not honour typographical errors on prices. Acceptance of orders: Bendicom reserves the right to refuse or cancel an order at any time, for any reason. In addition, an automated electronic order confirmation does not indicate acceptance of an order. By placing an order, the customer agrees that the sale is made in Victoria, Australia. All sales are not final until we ship the goods and therefore until we ship the goods, we reserve the right to alter our prices. If we alter our prices upwards, you may cancel your order without penalty. If we have not changed the price and you wish to cancel the order, you will be responsible for our reasonable costs up to the time of your cancellation. We will accept most items that we normally hold in stock for a return. You will be issued with a credit for the price of the goods less postage costs (you are not refunded postage).
Refund
Special Orders: If we make an order on your behalf for a special product a refund or exchange cannot be obtained. This will be made clear to you by our staff member when ordering and marked clearly on your invoice. For standard stock orders we provide a refund, credit or exchange if the product is: Dead on arrival, Damaged in transit or Incorrectly Shipped in its original packing within 7 days of the purchase date. Dead on arrive condition is according manufacturer’s standard. Such as notebook computers or LCD monitors: some models are 0 dead pixel guarantees, but some models are more than 6 pixels belong to dead on arrive. If you return a product because it is DOA (dead on arrival) but we find that the product is in full working condition or any defects or damage were caused after you took receipt of the product, it will be returned to you. We will send the goods back to you via COD standard postal charges will be payable at the receiving end. Unopened product, except OEM software, in its original, unopened and undamaged packaging within 7 days of the purchase date. A restocking fee of 10%-15% will apply on the all products due to prices changing rapidly. Products with valued over AU$2000 are usually order by request. You will need to package and address the product for return. We will not pay nor reimburse any costs associated with a customer-initiated return of unopened product. A credit will be issued for the original purchase price of the product less any associated freight costs. OEM Software may not be refunded, due to the exposed license key on the exterior of the product. Goods must be received before Refund/Exchange. Bendicom reserves the right to reject refund/credit/exchange of any product that is returned without all accessories and/or documentation, has been misused,or is not accompanied by the original invoice or other proof of purchase.
